1. In General
Access to and use of this mobile app and services available through this app (collectively, the “Services”) are subject to the following terms, conditions and notices (the “Terms of Service”). By using the Services, you are agreeing to all of the Terms of Service, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms of Service.
Access to this app is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this app is unavailable at any time or for any period. From time to time, we may restrict access to some parts or this entire app.
This app may also contain links to other websites or apps, which are not operated by Medilingo (the “Linked Sites”). Medilingo has no control over the Linked Sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. Your use of the Linked Sites will be subject to the terms of use and service contained within each such apps or sites.
2. Privacy Policy
MEDILINGO (“MEDILINGO”) is totally committed to protecting the privacy of our app visitors and customers. The MEDILINGO team members are customers themselves of other apps and fully appreciate and respect the importance of privacy on the Internet and your privacy as you use our app. We have developed and implemented policies and practices to comply with the provisions of the Personal Data Protection Act 2012 (the “PDPA”) and this Privacy Policy describes such policies and practices and what information we gather from you, how we use and/or disclose that information and what we do to protect it. Information We Gather
In order to become a member of MEDILINGO and have access to our members’ only areas, we ask you to subscribe to our mobile application and provide your full name and e-mail address. This registration information is personally identifiable information (“Personal Data”) because it allows us to contact you and distinguish you from other users.
Our mobile application allows you to purchase products and services, and we save these transactional information along with your location data on our servers. We may also receive or use additional information about your activities and/or transactions from other systems managed directly or indirectly by the company. These information are linked to your Personal Data. Though we must store your information on our servers, we will only use that information to provide you with product and service recommendations through our mobile application. Once we separate your transactional information from your Personal Data, so that it cannot be linked back to you, we may use such anonymised information for other purposes.
We may receive additional Personal Data from you through communications with on our website and mobile application. If so, we will use that information to fulfill your request and for aggregate reporting before deleting it from our system. For example, if you e-mail us to ask about a product, we will use that information to give you an answer, to make sure that you are satisfied with our answer, to have a history of our service to you and to make our service better by reporting your request, without any Personal Data, in our customer service totals.
Other Information
In order to maintain and improve our mobile application, we also gather some statistical data when you use the app. The exact information we collect may vary, but can include the date and time of an access to our app, the Internet Protocol address of a computer requesting a page, the pages requested, and computer and connection information such as browser type and operating system. We may associate this statistical information with your Personal Data.
Also, if you respond to a poll or questionnaire, we will aggregate your responses with users of our website and mobile application and may associate your response with your Personal Data to provide better product or service recommendations.
How We Use That Information
We do not rent, sell, transfer or otherwise disclose your Personal Data to any third party, except as expressly stated below. As noted, we gather the information discussed above for purposes of providing and improving our mobile application for you. For example, we use the information to provide you with product and service recommendations among other things.
As described above, we also aggregate information supplied by users during registration and information about their use of our website and mobile application to maintain our services and describe our user base to potential partners, investors and advertisers. In providing this information, however, we do not reveal any Personal Data, only supply summary data about our community of users.
There are some limited circumstances in which we may need to disclose Personal Data about you, and we want you to know about them.
We may employ other companies to perform functions on our behalf, such as providing customer service, sending e-mails, processing credit card payments, holding live chats, hosting message boards or other functions necessary for us to provide services to you. We may need to share your Personal Data with these companies. However, we will provide them with only the information necessary to perform their functions, and will not allow them to use that information for any other purposes.
In the interest of enhancing our service, we may form partnerships with other web-based services. MEDILINGO will reveal information, including Personal Data, to the extent it believes it is required to do so by law. If we are asked by subpoena or other legal means to disclose any of your Personal Data we will, if permitted by law, attempt to notify you via the e-mail address you supplied during registration at least ten days before we respond to the request.
MEDILINGO may transfer any information, including any Personal Data, in connection with a sale of all or most of the assets of the company.
Data Security
Your account is password protected so that only you may use it. We recommend that you do not divulge your password to anyone and MEDILINGO will never ask for your password by phone or e-mail. Also remember to log out from our app when you have finished your work to ensure that others cannot access your personal information and correspondence.
We have put in place a number of industry standard security measures to make sure your data is safe from loss, misuse, or alteration. These include industry standard encryption and other data security practices. Our team reviews our security system regularly, and upgrades it all the time to keep your data safe.
MEDILINGO employees and contractors are only given access to member data on a password-protected basis. It is our employment policy that this information is to be treated with the utmost confidentiality, and any misuse of this information is grounds for disciplinary action, including termination.
Transfers of your Information
The information that we collect from you may be transferred to, and stored at, a destination outside of Turkey. Unfortunately, the transmission of information via the Internet is not completely secure. We will do our best to protect your personal data, but cannot guarantee the security of data transmitted to our site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.
Third party sites / apps
Our site may contain links to and from the websites / apps of our partner networks, advertisers and other third parties. If you follow a link to any of these websites, please note that they have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.
Complaints
If you have any complaint(s) arising from the collection, use and/or disclosure of your Personal Data, please be informed that your complaint(s) can be sent to the Data Protection Officer at the postal and/or email address stated above.
Availability of Information
Upon your request, we will make available to you more information on our policies and practices developed and implemented by us as regards the collection, use and disclosure of Personal Data about you as well as our complaints process developed to receive and respond to your complaint(s).
Withdrawal of Consent
Should you wish to withdraw your consent to the collection use and disclosure of your Personal Data for any of the purposes stated, you may do so by sending us a notice to the Data Protection Officer at the postal and/or email address stated above, stating the following information:
Your name and identification number; and
The purpose(s) that you had previously consented to for which you wish to now withdraw your consent for.
Please note that we may be unable to continue to provide certain products and/or services to you as a result of your withdrawal of consent and your withdrawal of consent will not affect any legal consequences arising from such withdrawal.
Access to your Personal Data
Upon request by you (the “Access Request”), we shall provide you with the following information:
a. personal data about you that is in our possession or under our control; and/or
b. information about the ways in which your personal data have been or may have been used or disclosed by us within a year before the Access Request.
To make an Access Request, please write to the Data Protection Officer at the postal and/or email address stated above, and kindly include your name and identification particulars and such information that we may require to identify you and the relevant personal data.
Please be informed that we are entitled to charge a fee to recover the costs directly related to the Access Request for the time and effort spent by us in responding to your Access Request, and will let you know the amount accordingly.
Please also note that under the PDPA, we are not required to provide you with certain categories of information listed under the PDPA.
Correction of Personal Data
You may request us to correct an error or omission in relation to personal data about you that is in our possession or under our control by writing to the Data Protection Officer at the postal and/or email address stated above, including your name and identification particulars and such other information that we require to identify you and the relevant personal data.
Policy Changes
If we change this Privacy Policy in any substantial way, we will notify you at least thirty days in advance by posting a notice of the change prominently on our site. Changes will not be applied retroactively to information obtained under a previous policy without your express consent.

3. Prohibitions
You must not misuse this app. You will not: commit or encourage a criminal offence; transmit or distribute a virus or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person’s proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as “spam”; or attempt to affect the performance or functionality of any computer facilities of or accessed through this app. Breaching this provision would constitute a criminal offence under the Computer Misuse and Cyber Security Act 1993. MEDILINGO will report any such breach to the relevant law enforcement authorities and disclose your identity to them.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your mobile phone, mobile apps, data or other proprietary material due to your use of this app or to your downloading of any material posted on it, or on any websites / apps linked to it.
4. Intellectual Property, Software and Content
The intellectual property rights in all software and content made available to you on or through this app remains the property of MEDILINGO or its licensors and are protected by copyright laws and treaties around the world. All such rights are reserved by MEDILINGO and its licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this app nor may you use any such content in connection with any business or commercial enterprise.
You shall not modify, translate, reverse engineer, decompile, disassemble or create derivative works based on any software or accompanying documentation supplied by MEDILINGO or its licensors. No licence or consent is granted to you to use these marks in any way, and you agree not to use these marks or any marks which are colourably similar without the written permission of MEDILINGO.
5. MEDILINGO Community Areas
a) Registration
MEDILINGO reserves the right to close an account if any user is seen to be using proxy IPs (Internet Protocol addresses) in order to attempt to hide the use of multiple accounts, or disrupts any of our services in any way.
b) Submission of material
The Service provides you with the ability to interact with social media services, such as through Facebook “Like” buttons, Twitter and otherwise. These features may enable integration and/or access to your social media accounts. We do not control those social media services, your profiles on those services, modify your privacy settings on those services or establish rules about how your personal information on those services will be used. You and the social media service providers are in control of those issues, not MEDILINGO. You are encouraged to read all policies and information on the applicable social media services to learn more about how they handle your information before using any such features made available to you on our Service. We are not responsible for any acts or omissions by any social media service provider or your use of features that come from their platform.
6. Disclaimer of Liability
The material displayed on this app is provided without any guarantees, conditions or warranties as to its accuracy. Unless expressly stated to the contrary to the fullest extent permitted by law MEDILINGO and its suppliers, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this app or the Linked Sites / Apps and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect MEDILINGO’s liability for fraudulent misrepresentation, misrepresentation as to a fundamental matter or any other liability which cannot be excluded or limited under applicable law.
7. Linking to this app
You may link to our app, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
You must not establish a link from any website that is not owned by you.
This app must not be framed on any other site, nor may you create a link to any part of this app other than the home page. We reserve the right to withdraw linking permission without notice.
8. Indemnity
You agree to indemnify, defend and hold harmless MEDILINGO, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use this app or your breach of the Terms of Service.
9. Variation
MEDILINGO shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of this app.
10. Invalidity
If any part of the Terms of Service is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms of Service will not be affected all other clauses remaining in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.
11. Complaints
We operate a complaints handling procedure which we will use to try to resolve disputes when they first arise: please let us know if you have any complaints or comments.
12. Waiver
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
13. Governing Law and Jurisdiction
These terms and conditions are to be construed in accordance with the laws of Turkey and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the Turkish courts.
14. Entire Agreement
The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and MEDILINGO. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of MEDILINGO.
